This document is intended to serve as an agreement for all business between you the customer and us Beyond Programs. This includes all services and products extended to you through Beyond Programs solely or in conjunction with any of its partners.

LICENSE TO USE WEBSITE


BePro Software is a brand owned and operated by Beyond Programs Ltd. Unless otherwise stated, Beyond Programs Ltd and/or its licensors own the intellectual property rights in the website and material on the website. Subject to the license below, all these intellectual property rights are reserved.

You may view, download for caching purposes only, and print pages or [OTHER CONTENT] from the website for your own personal use, subject to the restrictions set out below and elsewhere in these terms and conditions.

ACCEPTABLE USE


You must not use this website or applications sold on this website, in any way that causes, or may cause, damage to the website or impairment of the availability or accessibility of the website; or in any way which is unlawful, illegal, fraudulent or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity.

You must not use this website or applications sold on this website to copy, store, host, transmit, send, use, publish or distribute any material which consists of (or is linked to) any spyware, computer virus, Trojan horse, worm, keystroke logger, rootkit or other malicious computer software.

You must not conduct any systematic or automated data collection activities (including without limitation scraping, data mining, data extraction and data harvesting) on or in relation to this website without Beyond Programs Ltd’s express written consent.

You must not use this website to transmit or send unsolicited commercial communications.

RESTRICTED ACCESS


Access to certain areas of this website is restricted.] Beyond Programs Ltd reserves the right to restrict access to [other] areas of this website, or indeed this entire website, at Beyond Programs Ltd’s discretion.

If Beyond Programs Ltd provides you with a user ID and password to enable you to access restricted areas of this website or other content or services, you must ensure that the user ID and password are kept confidential.

Beyond Programs Ltd may disable your user ID and password in Beyond Programs Ltd’s sole discretion without notice or explanation.

VENDORS
Anyone can apply to become a vendor on BeyondPrograms.ca. For the purpose of this agreement, a product is a digital application which is designed to help users accomplish an internet based task. If your service is accepted, your sales will be governed by the following terms.

  1. Your listings will be de-activated and no longer searchable, 365 days after of your purchase.
  2. The price shown on BeyondPrograms.ca must be equal to or more than the cost at the payment gateway
  3. Do not upload or attempt to sell malicious products or content through BeyondPrograms.ca
  4. You must own all artwork, trademarks and content uploaded to BeyondPrograms.ca. Upon upload, you share all rights with BeyondPrograms.ca 
  5. If your country requires that you collect tax, its your responsibility to include it in your price. E.g. if you are located in the EU, you may need to consider VAT.
  6. You must provide support to customers for their purchase of your service or note that support is not available in your service description.
  7. You must provide installation and configuration documentation if applicable.
  8. All information posted to BeyondPrograms.ca must be truthful and kept up to date.
  9. Any website links you share, must go to a website with PG13 or lower rated content or clearly indicate otherwise
  10. Content posted on BeyondPrograms.ca must be PG13 or lower.
  11. Your profile page must not contain any tracking code

Failure to follow the rules risks deletion of your listings and account from BeyondPrograms.ca. In such a case, you yearly listing fee.

USER CONTENT
In these terms and conditions, “your user content” means material (including without limitation text, images, audio material, video material and audio-visual material) that you submit to this website, for whatever purpose.

You grant to Beyond Programs Ltd a worldwide, irrevocable, non-exclusive, royalty-free license to use, reproduce, adapt, publish, translate and distribute your user content in any existing or future media. You also grant to Beyond Programs Ltd the right to sub-license these rights, and the right to bring an action for infringement of these rights.

Your user content must not be illegal or unlawful, must not infringe any third party’s legal rights, and must not be capable of giving rise to legal action whether against you or Beyond Programs Ltd or a third party (in each case under any applicable law).

You must not submit any user content to the website that is or has ever been the subject of any threatened or actual legal proceedings or other similar complaint.

Beyond Programs Ltd reserves the right to edit or remove any material submitted to this website, or stored on Beyond Programs Ltd’s servers, or hosted or published upon this website.

Notwithstanding Beyond Programs Ltd’s rights under these terms and conditions in relation to user content, Beyond Programs Ltd does not undertake to monitor the submission of such content to, or the publication of such content on, this website.

REFUNDS
By purchasing products and or services on www.BeyondPrograms.ca, you agree to the following refund terms. Furthermore, you agree that they are fair, considering that you can make money immediately after payment. THERE ARE NO REFUNDS

CONTRACT ALTERATIONS

There is no way to alter a project at Beyond Programs once it has started. Cancellations are always possible and subject to penalties outlined within your payment agreement are below in this document under payments. Additions to projects are terms new projects entirely and cannot run parallel. Independent projects can run parallel once they both meet all necessary requirements.

SERVERS

All hosting agreements involve hosting on our personal servers. Unless otherwise noted, these servers are hosted in the Caribbean and or Latin america.  Hosting on our servers have monthly and yearly payment options.

All companies and individuals undergoing hosting agreements simply need to follow the law. Beyond that, we do not support or house fridge products which engage in, pornography,  gambling, unlicensed product sales, or hatred towards any aspect of humanity.

There is no guarantee of security or up time from our servers. By undertaking a hosting agreement with us you agree that the selling point here is, a) removing a 3rd party, b) limited and screened neighbors, c) special configurations.

MAINTENANCE AND MONITORING

With all packages, a minimum maintenance package of 20 days is included. Beyond that, we offer monthly maintenance and monitoring packaged. Maintenance includes responding to breakdowns in technologies which are easily created as libraries and specifications change.

Maintenance does not included improvements to any product. Requests of this nature will be forwarded to our development department. At the end of any maintenance engagement, the result will be a functioning product. Its look and feel may change as the owners of the technologies implement changes.

Monitoring in no ways guarantees security. This service simply provides you with a 3rd party actively looking at the statistics of your site while recording and reporting major crippling changes to you. This service in no way guarantees that we will see all issues related to your site.

PAYMENTS

All payment agreements must be finalized before the project starts. Payment frequency and amounts are determined by, project scope, employer location, timeline, technologies involved, and project frequency to name a few.

Generally for small projects an indevidual is expected to pay an upfront milestone, followed by a 90% payment and finally the 100% payment. Larger projects have steps inbetween (40%, 75%, etc) while longer running projects have fixed payments and or % payments monthly.

Failure to pay an invoice will result in an immediate halt to development. Invoices are presented only at agreed intervals and after feedback from the customer agreeing to the state of the product.

90 PERCENT

90% means that the product looks similar to the agreed design and is functional. At this point there are still bugs and design tweaks to be agreed upon before launch. This is usually about 2-4 weeks before the intended launch of a project from small to enterprise. A total of 90% of the total budget must be paid at this time before anymore development.

COMMUNICATION

We guarantee communication in the form of project updates at the beginning and end of every week that your project is active. At any time you feel that you have not received this communication, please reach out to us immediately.

Some projects come with communication packages. This means an amount of hours in a week or over a project that you are able to contact us for any reason regarding your project for free.  All other communication costs $15/hr with a minimum of 1 hour once started.

Failure to reply to inquiries regarding your project will result in a complete halt to all development if not replied to within 48 hours. We believe that no one has a larger investment in your project that you. Without your input how can your product be completed?

SECURITY

Security is a major product on its own. Unless specifically requested, outside of secure programming tactics, there is little offered in the way of security below medium sized projects.  Many cms systems employ their own security standards which must be agreed to as adequate for small projects. We offer the implementation of well documented security procedures and processes. In no case does Beyond Programs guarantee any level of security.

Software today is inherently unsecured. Billions of dollars are made and lost in the security industry. We at Beyond Programs simply intend to help the little man by offering tools for, monitoring, recording, and responding to various security threats.

Unfortunately, we do not offer any preventative measures outside of the development process. We would love to partner with you on your next project to plan the security from the ground up to give your product the best chance possible at secure operation.

DEVELOPMENT STOPPAGES

Stoppages caused by an issue out of our control are subject to scheduling. This means that if your project is stopped, the original timeline is no longer applicable. The project is then put in a queue where it waits for availability. This will not exceed 5 business days.

Scenarios that can cause this are outlined throughout this document.

PARTNERSHIPS

We ask that you place our link in the footer of any site that we develop.  This small gesture helps us to grow so we can be around for your next project. Agreement to this gives another 30 days of maintenance to any package where a complete, site, mobile, or desktop product was developed by us.
